Litigation
In a commercial
setting we would usually regard legal collection as being the last
resort however, it can prove to be the most cost-effective method. You
can normally recover most of your costs and interest as well. With the
introduction of the Late Payment legislation you may also be able to
claim compensation fees for recovery costs.
We do however
stress caution when issuing legal proceedings as there is no guarantee
of a successful collection. Therefore before instruction is
given, we advise you to consult with us first.

County Court Proceedings
In the event
that our pre-legal action fails to stir up the right
response and insolvency is inappropriate, then it is time to issue legal
proceedings through the County Court. Since a recent overhaul of the
Court service, all money claims are now issued in this way, although if
your claim is less than £5K it will be subjected to the Small
Claims procedure. Claims issued by this agency will be dealt with
generally within 24 hours of receiving your appropriate Court fee and paperwork.
A claim will
be issued by one of Debt Recovery Direct's affiliated solicitors on
your behalf in the County Court. If no defence to the claim is made by
the debtor, within the timescale allowed by the Court, we will
automatically ask the Court to grant Judgement to you. Once Judgement
is granted a County Court Bailiff (for claims below £600) or a
High Court Sheriff (for claims above £600) will be instructed to
visit your debtor to enforce your debt plus court fees, cost, and
interest.
If at any time
during a Legal Action a defence to the claim is received, Debt Recovery
Direct will liaise with you and conduct the case on your behalf. The
charge for this service is £80 per hour.

As an
alternative to filing a claim through the County Court System you can
go straight to insolvency by way of a Statutory Demand or Winding Up
Petition for corporations or a Bankruptcy Petition and Statutory Demand
for individuals
