Legal or pre legal, What's the difference?
PreLegal debt recovery involves DRD's senior Collection Managers
pursuing your
debtors by letters and telephone calls. This service
is
on a commission basis.
Your alternative is to "go legal" straight away. This involves asking
us to send a letter threatening legal proceedings. If the debt is not
paid, court proceedings are started 7 days later. The fees are payable
win or lose and are mostly recoverable from the debtor when he pays.

Which
should
you
use?
In a
commercial setting we would usually regard legal collection as being
the most cost-effective method. You can normally recover most of your
costs and interest as well. With the introduction of the Late Payment
legislation you may also be able to claim compensation fees.
PreLegal is, however, useful where:

You initially want a softer approach

You prefer not to take the risk on
legal costs, perhaps because of the size of the debt or a known dispute

You regard the chances of recovery as
uncertain

Where an LBA has not been responded to
and you don't wish to issue proceedings.
3. Will I have to attend court?
In most cases you will not need to attend court. DRD will complete all
the paper work that is required. If the claim is defended we will
mediate with the debtor to try and resolve the case or move for the
courts to make a judgment.
4. How do I place a
debt with you?
Our aim is to make the process as simple as possible for you. You can
submit a debt online,
by email, fax or telephone.
5. My customer
base is a mixture of limited companies and non-incorporated businesses.
Does this matter?
No, not at all. We collect from all types of commercial debtor.
6. How can I pay
the court fees?
Court fees are payable in advance. An invoice will be sent to you which
can be settled by direct bank transfer or cheque.
7. I have an
old ledger of debt that I need help in collecting. Can you offer a
service?
We are set up to handle large volumes of accounts at varying stages of
collection. Our approach is flexible and is designed to retain customer
loyalty where still appropriate.
8. How often
will you contact me about my cases?
We will contact you at all the key points in the progress of your case
and guide you through these.
9. What form will that contact take?
We think that our online service will tell you all you want to know. We
will contact you by email, fax, post or telephone.
10. Where will they send the
money to?
We request all monies be sent to you directly. If payment is made to us
the money will be paid into your client with our bank. If the
payment is made by cleared funds then payment will be made the same day
if received before 2.30p.m. If received after 2.30p.m. the payment will
be made the next working day.
